1– INTRODUCTION
Our plans include one year of service support. After one year if you do not re-new the desired service, you will no longer have access to our services and support.
According to historical data, the growth rate of digital currencies is quite higher than the growth rate of other markets such as gold, currency and stock exchanges.
In addition, the performance of our smart trading algorithm is significantly higher than the intrinsic growth rate of digital currencies over time.
But in any case, the digital currency market is one of the riskier markets, and you have to enter this market by accepting this fact.
We do not warrant the initial capital of your portfolio or its value at any time or any money invested in any financial instrument. You should completely acknowledge and accept that you run a great risk of incurring losses and damages as a result of the purchase and/or sale of any financial instrument and accept and confirm that you are prepared to take on this risk.
1-1- The Service is made available to you by Uniarma GmbH, a company incorporated under the laws of the Germany (“Uniarma”, “we”, “us” or “our”) through the website at https://uniarma.de. The term “you” or “customer” refers to the individual visiting or otherwise accessing or using the Software.
1-2- These Terms of Service (“Terms of Use”) and the Privacy Policy (as defined below) govern your access to and use of the Software and constitute the entire, complete, and binding agreement between you and us with respect to the Software.
1-3- You should also read our Privacy Policy at https://uniarma.de/privacy-policy, which is incorporated into the Terms of Service by reference. If you do not wish to be bound by these Terms of Use or our Privacy Policy, please do not access or use the Software.
1-4- THESE TERMS OF USE CONTAIN VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS AND EXCLUSIONS. PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE ACCESSING OR USING THE SOFTWARE. BY USING THE SOFTWARE IN ANY MANNER AND FOR ANY PURPOSE, WITH OR WITHOUT A CLIENT ACCOUNT, AND FROM ANY DEVICE AND LOCATION, YOU AGREE AND ACKNOWLEDGE THAT:
1-4-1- You have read and understood these Terms of Use and you accept and agree to be bound by these Terms of Use as of the date you use the Software.
1-4-2- You assume all obligations set forth herein
1-4-3- You are of legal age and able to use the software
1-4-4- You are not subject to the control of any jurisdiction that expressly prohibits the use of similar software
1-4-5- You use the software at your own discretion and under your own responsibility.
2– SUBJECT OF THE TERMS OF SERVICE
2-1- These Terms of Use are between Uniarma and the customer using the software. The software is made available to you via the website https://Uniarma.de on a computer or mobile device.
2-2- These Terms of Use constitute a legally binding agreement between you and Uniarma and cover the operation and delivery of the Software. The software is made available to individuals and legal entities with existing exchange accounts and is intended to help them better manage their personal cryptocurrency holdings. You may not use the Software to manage third-party cryptocurrency holdings in any way.
2-3- Uniarma may update or revise these Terms of Use from time to time by providing notice of such updates or revisions to the Software. Such changes to the Terms of Use will be effective as of the “Last Updated” date specified at the beginning of these Terms of Use. Each time you access the software, you agree to be bound by the most current version of the Terms of Use. You agree to review these Terms of Use periodically. If you do not agree to the terms of these Terms of Use or any modified version of these Terms of Use, your only remedy is to terminate your use of the Software.
- REGISTER
3-1- You must be at least eighteen (18) years old to register and use the Software.
3-2- If you are entering into these Terms of Service on behalf of an entity (i.e., a corporation or other legal entity), you represent that you have the authority to bind that entity to these Terms of Service and that you will retain all email addresses, passwords, and Access data with other persons authorized to represent the legal entity. If you do not have such permission, you may not access or use the software.
3-3- Before registering, you are solely responsible for ensuring that use of the Software in accordance with these Terms of Use is legal under the applicable laws of your country of residence. If such use is not permitted by law, you may not access or use the Software.
3-4- The following steps are required to log in to create the customer account and access the software:
3-4-1- Register. Fill out the registration form by providing your email address and password. You will be given the opportunity to read the Terms of Use and the Privacy Policy. You can access and take note of the documents under the links provided. Before clicking “Place Order” or “Register” to continue the sign-up process, you must confirm that you accept these Terms of Use and that you are familiar with our Privacy Policy. You must also confirm that you are at least 18 years old. After you click on “Register”, your account will be created (“Customer Account”).
3-4-2- From the moment Uniarma provides you with the customer account to access and use the software, the registration process is complete. Uniarma has the right, in its sole discretion, to refuse you a customer account, in which case you may not use the software.
3-4-3- You can terminate the registration process at any time and/or suspend the process and continue at a later time. You can check your entries for errors and, if necessary, correct them by changing your entries.
3-4-4- After creating the customer account, you will be asked to complete your customer account profile and you will be guided through various steps, including connecting your customer account to your existing cryptocurrency exchange account.
3-4-5- Connection to a cryptocurrency exchange account. In order to use the features of the Software, you must have a cryptocurrency exchange account (“Exchange Account”) in Binance.
In order to connect your exchange account to the customer account, you need to log into your exchange account, create an API key and API secret, then return to the software, navigate to the “Account details” form and enter the API key and enter the API secret. Before that you must be sure that the Exchange account is yours personally and you are not connecting someone else’s account.
In certain circumstances we may delete the API keys for security reasons, requiring you to reconnect to your Exchange account.
3-5- As part of the sign-up process, you must provide us with certain information, such as your email address and a password. For more information about the data we collect, please see our privacy policy at https://uniarma.de/privacy-policy. You are required to provide accurate, current and complete information about yourself and to promptly update all information in your customer account to ensure that your customer account is accurate, current and complete. You can update or change your customer account settings at any time.
- USE OF YOUR CUSTOMER ACCOUNT TO ACCESS THE SOFTWARE
4-1- The purpose and permitted uses of your customer account and the software
4-1-1- You may use the software only within its intended purpose and permitted use. You acknowledge that the purpose of the customer account, depending on the chosen plan. Use for other purposes or, in particular, misuse of the software is not permitted. In particular, you agree not to use your customer account and the software to:
4-1-1-1- upload, post, email, transmit or otherwise make available any unlawful, harmful, threatening, abusive, fraudulent, harassing, abusive, defamatory, vulgar, obscene, defamatory, invasive of another’s privacy, hateful or racist content that promotes violence, is pornographic, unethical or otherwise prohibited or objectionable
4-1-1-2- impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity
4-1-1-3- transmit or otherwise make available any content that you do not have the right to provide, that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment
4-1-1-4- Engage in any activity that attempts to reverse engineer, disassemble, decompile, hack, or extract proprietary software used to maintain the Software
4-1-1-5- trading on platforms you should not have access to
4-1-1-6- interfere with or interfere with the Software or servers or networks connected to the Software, including without limitation hacking or circumventing any measures we may use to prevent unauthorized access to the Software; and or
4-1-1-7- violate applicable national or international rules and laws as well as the rights of third parties.
4-1-2- Failure to comply with the purpose limits and permitted uses of your Client Account and Software (including where we discover activity related to you managing multiple accounts from the same cryptocurrency exchange accounts through your personal Client Account without having subscribed to the appropriate plan) will be considered a material breach of viewed these Terms of Use. 3 Commas is entitled – without prejudice to all other rights – to terminate your customer account in accordance with sections 12.3.2 and 12.3.3. You may not use the software if we have terminated your customer account or otherwise suspended you.
4-2- Customer Account Confidentiality
4-2-1- You acknowledge that your customer account is personal to you and you agree not to allow any other person to access the Software or any part of it using your email address, password or other security information.
4-2-2- You are responsible for maintaining the confidentiality of your information and for monitoring and, if necessary, restricting access to your devices. Any email address, password or other information you choose or provide to you as part of our security procedures must be kept confidential and not disclosed to any other person or entity. You must use caution when accessing your customer account from a public or shared computer to prevent others from viewing or recording your password or other customer account information. You agree to ensure that you log out of your customer account at the end of each session.
4-2-3- You accept responsibility for all activities that occur under your customer account or from your devices in relation to the software and your customer account, including any misuse of your customer account. Uniarma will take reasonable and industry standard security measures to protect you from unauthorized access to your customer account. You agree to notify us immediately of any unauthorized access to or use of your customer account or any other breach of security. If you do not notify Uniarma accordingly, Uniarma may not be able to prevent such unauthorized access or other breach of security or take appropriate security measures.
4-2-4- To ensure better protection of your customer account, you have the option of setting up two-factor authentication via Google Authenticator under the “Settings” of your customer account.
4-2-5- You acknowledge and agree that, to the fullest extent permitted by applicable law, we shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with any unauthorized use of your customer account or allegedly caused by any failure on your part to maintain confidentiality of your password where we have complied with our obligation to use reasonable and industry standard security measures.
5– TRIAL ACCOUNT
5-1- If you have opted into a free trial, we are making the Software available to you free of charge on a trial basis (“Trial”). By gaining access to the Software, you agree to be bound by our Terms of Service and the following additional terms of this Section 5 (“Trial Terms”), provided that in the event of any conflict between the Trial Terms and any other term of these Terms of Service, the test conditions. Uniarma has the right to deny you access to a trial version.
5-2- In order to gain trial access to the software, you must go through the registration process outlined in Section 3. You can cancel the trial at any time and for any reason in the customer account settings where we have made this option available to you.
5-3- The trial begins when we approve your trial and ends on the earlier of (a) the end of the free trial period for which you have registered or (b) the start date of any purchased subscription (as defined in Section 7). At the end of the Trial Period, any trades you have initiated through the Software during the Trial Period will continue but may take longer to complete and you will no longer have access to any data you have entered into your Client Account.
5-4- We may terminate your use of the Trial Version and the products and services made available thereby, at any time and for any reason, for any or no reason, without prior notice to you and without any liability or further obligation whatsoever to you or any other party.
6– CUSTOMER ACCOUNT FUNCTIONALITIES
6-1- Customer Account gives you free access to Dashboard, Blog, Uniarma API, Paper Trading (under SmartTrade Terminal), Portfolio Track and Community features provided by Uniarma as described in this Section
6-2- The Software provides you with tools to manage your cryptocurrency holdings across the Exchange accounts, including but not limited to the following tools:
6-2-1- SmartTrade Terminal, which shows you smart orders on third-party cryptocurrency exchanges using third-party public API and Uniarma “SmartTrade Terminal” functions. Under the SmartTrade Terminal feature, you can enable the Paper Trading feature, which allows you to simulate trading without risking real assets.
6-2-2- Trading bots that allow you to configure the parameters of the selected bot that automatically submit cryptocurrency trading orders to third-party cryptocurrency exchanges within these set parameters and without the performs need for additional human interaction or intervention
6-2-3- Dashboard that tracks your account balances on various connected Exchange account and shows the summary of your account
6-2-4- Portfolios, which allow you to analyze how certain portfolio setups have performed in the past and apply the chosen setup to your existing exchanges
6-2-5- blog providing you with information and news about cryptocurrencies and trading;
6-2-6- Community that provides you with live chat, customer support and related services.
- PURCHASE OF SUBSCRIPTION
7-1- When registering for the Plans, you will be given the opportunity to choose between different plans, i.e. H. “Free”, “Small”, “Medium” and “Unlimited” plans (collectively “Plans” or “Subscription”).
7-2- For a detailed description of Uniarma subscriptions, including pricing and the features associated with each subscription type, visit our Plans page or Help Center. Uniarma reserves the right to change (e.g. add or remove plans) the subscriptions published on the Plans page at any time. When cancelling a plan, Uniarma will notify those who may be affected by such actions.
7-2-1- Subscriptions available on the Plans page are subject to these Terms of Service. By accepting these Terms of Service, you also confirm that you agree to the terms of the Subscription Features as described on the Plans page.
7-3- Uniarma reserves the right, in its sole discretion, to provide Services to customers based on customized plans (“Custom Plans”). Custom plans are not displayed on the Plans page and are offered to customers individually.
7-4- To purchase the subscription other than a custom plan, select the subscription you wish to purchase from the “Plans” page of our website or from the “Plans” page and select the preferred payment method. All debit/credit card and Paypal payments are processed by our registered merchant. Before clicking the “Pay” button, you must confirm that you accept its Terms of Use and the Privacy Policy. In addition, you must confirm that you are at least 18 years of age and consent to receive the subscription features at the time of entering into the purchase agreement. The selection of the subscription, the subscription period (e.g. one month or one year) and the submission of your payment information is an offer to enter into an agreement with Uniarma for the use of the software functions provided under the selected subscription based on these terms of the use effective as described in Section 3.4 (“Sales Agreement”). The offer must be accepted by us. We may, at our sole discretion, refuse the offer. The purchase agreement will be accepted at the time you receive confirmation from us or we activate your selected subscription features as described below. Uniarma will not save the text of the purchase agreement after the conclusion of the purchase agreement. However, the text of the Purchase Agreement is made available to you in a downloadable format on the Terms of Use page. The conditions set out in Section and 3.4.3 above apply hereto, except as otherwise provided in this Section 7. The term of the Purchase Agreement is the Subscription Term you have chosen and is subject to the termination provisions of Section 12.
7-5- If you wish to upgrade your subscription, you can do so at any time via the “Subscription” tab of your customer account. Your new subscription will start after the payment is processed. Your new subscription will be activated immediately after your payment is processed, regardless of the time left on your old subscription. Ordering a new subscription will result in the immediate cancellation of the purchase agreement relating to your old subscription and the conclusion of a new purchase agreement for the new subscription. Any amounts that you may be due from your old subscription will be credited to your new subscription, i.e. you only pay the difference between your payment for the new subscription and the portion of the funds that were not used under the old subscription. To terminate the purchase agreement, see Section 12.4.

UNIARMA IS NOT A BROKER, FINANCIAL ADVISER, INVESTMENT ADVISER, PORTFOLIO MANAGER OR ACCOUNTANT. NOTHING ON OR IN THE SOFTWARE MAY CONSTITUTE AN OFFER OF ANY CURRENCY OR FINANCIAL INSTRUMENT, OR INVESTMENT ADVICE OR RECOMMENDATIONS (E.G., A RECOMMENDATION TO PURCHASE ANY CURRENCY OR AN INSTRUMENT) BY UNIARMA OR A RECOMMENDATION REGARDING ANY INVESTMENT STRATEGY OF UNIARMA. YOU ACKNOWLEDGE AND AGREE THAT UNIARMA IS NOT RESPONSIBLE FOR YOUR USE OF ANY INFORMATION OBTAINED THROUGH THE SOFTWARE. YOUR DECISIONS, RELIANCE ON THE PRODUCTS OR SERVICES IN THE SOFTWARE, OR YOUR INTERPRETATIONS OF THE DATA FOUND IN THE SOFTWARE ARE YOUR OWN DECISIONS, FOR WHICH YOU HAVE FULL RESPONSIBILITY. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SOFTWARE IS AT YOUR SOLE RISK.
8-2- UNIARMA WILL ENDEAVOR TO ENSURE THE ACCURACY OF THE INFORMATION CONTAINED ON THIS SITE BUT ASSUMES NO RESPONSIBILITY FOR MISSING OR INCORRECT INFORMATION. NO CONTENT OF THE SOFTWARE IS TAILORED TO THE SPECIFIC NEEDS OF ANY INDIVIDUAL, PERSON, OR GROUP OF PERSONS. UNIARMA EXPRESSES NO OPINIONS AS TO THE FUTURE OR EXPECTED VALUE OF ANY CURRENCIES, COLLATERAL OR OTHER INTERESTS. ANY CONTENT OF THE SOFTWARE MAY NOT BE USED AS A BASIS FOR ANY FINANCIAL OR OTHER PRODUCTS WITHOUT THE EXPRESS PRIOR WRITTEN CONSENT OF UNIARMA.
8-3-SOME CONTENT MADE AVAILABLE ON THE SOFTWARE IS SUBMITTED TO UNIARMA BY UNAFFILIATED THIRD PARTIES. MORE CONTENT WILL BE UPLOADED BY YOU. UNIARMA DOES NOT CHECK ALL CONTENT FOR ACCURACY, VERIFYS ANY CONTENT FOR COMPLETENESS OR RELIABILITY, AND DOES NOT WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY OR OTHER ASPECTS OF ANY CONTENT. THE PERFORMANCE OF THE SOFTWARE IS DIRECTLY LINKED TO THE PERFORMANCE OF THE UNRELATED THIRD-PARTY SERVICES. UNIARMA DISCLAIMS ALL RESPONSIBILITY FOR FAILURE TO PERFORM THE SOFTWARE CAUSED BY FAILURE TO PERFORM ANY UNRELATED THIRD-PARTY SERVICES.
8-4- YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU MAY LOSE SOME OR ALL OF YOUR MONEY. CRYPTOCURRENCIES ARE A NEW AND UNDERTESTED TECHNOLOGY. IN ADDITION TO THE RISKS CONTAINED HEREIN, THERE ARE OTHER RISKS RELATING TO YOUR USE OF THE SOFTWARE AND THE PURCHASE, HOLDING AND USE OF CRYPTOCURRENCIES, INCLUDING THOSE THAT UNIARMA CANNOT PREDICT. SUCH RISKS MAY FURTHER MATERIALIZE AS UNEXPECTED VARIATIONS OR COMBINATIONS OF THE RISKS DESCRIBED HEREIN.
- INTELLECTUAL PROPERTY AND LICENSE TO USE THE SOFTWARE
9-1- The Software, Trademarks and other intellectual property items displayed, distributed, or otherwise made available through the Software are the exclusive property of Uniarma, assigns, licensors and/or suppliers. Except as expressly provided in the Terms of Use, or unless you have agreed otherwise in writing with Uniarma, nothing in these Terms of Use gives you any right to use the Software and its Content, the Uniarma Trademarks or any other intellectual property of Uniarma.
9-2- Uniarma grants you a personal, nonexclusive, nontransferable, non-sublicensable, revocable license to use the Software for your use as described in these Terms of Use for the period you access the Software and use the features in the connection with the subscription, if relevant. All intellectual property objects (without limitation any information, data, products, materials, services, software applications and tools, design elements, text, images, photographs, illustrations, audio and video content, artwork and graphics contained therein or otherwise made available to you in connection therewith) provided by or used to operate the Software is licensed, not sold, to you by Uniarma. You acknowledge that you have no right to access the software in source code form. Uniarma may notify you by notice in the Software or otherwise that the Software contains intellectual property that is subject to a license from a third party, and you agree to comply with the terms of the Software.
9-3- Except as permitted in writing by a separate agreement with us, you have no right to rent, lease, lend, sell, redistribute, sublicense, copy, reverse engineer, reverse engineer, decompile any copies , disassemble, translate, modify, or distribute, make available, adapt, or create derivative works based on the Software or related intellectual property.
9-4- For any content and data that you insert or make available through the Software (“User Content”), you grant Uniarma a transferable, sublicensable, nonexclusive, irrevocable, worldwide right to use and exploit it, free of charge, and for the maximum term permitted by applicable law is permitted and unlimited in content to use such User Content for any purpose, including but not limited to the following purposes:
9-4-1- providing the software
9-4-2- conduct research, develop new products and services
9-4-3- forward-looking analysis and insights
9-4-4- improvement and further development of the software; and
9-4-5- other, including commercial use (“right of use and exploitation”).
9-5- The right of use and exploitation includes, but not exclusively the right to change, edit and translate as well as to save, reproduce, distribute, make publicly available, send, publicly and non-publicly disclose and otherwise make the User Content available, including but not limited to any bots you create, the names of such bots, and any settings you create for such bots. By entering or providing User Content via the Software, you guarantee that the User Content complies with these Terms of Use, does not infringe the rights of third parties and that you are entitled to grant these rights of use and exploitation. You release Uniarma from all claims that third parties assert against Uniarma in connection with the exercise of these rights of use and exploitation.
